Constitutional Crisis looms in Rivers State as Industrial Court reinstates sacked APC Council Chairmen

Nigerians are yet to see the end of the melodrama playing out in Rivers State as National Industrial Court sitting in Yenegoa, Bayelsa State has ordered the reinstatement of sacked All Progressive Congress (APC) Local Government Chairmen. The elections of the Chairmen conducted in the twilight of former Governor, Rotimi Amaechi’s tenure on May 23, 2015 were declared null and void by Justice Lambo Akanbi of the Federal High Court on July 9.

In the judgment, Justice Akanbi ruled that the poll conducted by the Rivers State Independent Electoral Commission  under the watch of Augustine Ahiauzu was illegal, a demonstration of executive lawlessness and impunity and total disregard of a substantive court injunction obtained by People Democratic Party (PDP) before elections were conducted. PDP that boycotted the elections and termed exercise illegal.

But another counter ruling on Monday, July 13 by the Justice Agbadu Fishim of the National Industrial Court, Yenagoa, Bayelsa State he ordered the reinstatement of the sacked 22 council chairmen by the Inspector-General of Police, Solomon Arase whom he instructed to implement the industrial court ruling.

Though,  Justice Agbadu-Fishim  instructed all involved  in the matter to appear before the industrial court on October 5 for hearing and determination of the motion, the stage seems set for show down between the two feuding parties in the state,  the APC and PDP as the same court ruling on June 22, restraining the State Governor, Nyesom Wike, the state house of assembly, the attorney-general of the state and their agents from dissolving, suspending, sacking, terminating or interfering in any manner whatsoever with the administrative functions of the 23 local government councils was ignored.

Justice Agbadu-Fishim  in the June 22 order equally stopped the IGP, his agents and proxies from enforcing any supposed action that is detrimental to the performance of official duties of the 23 chairmen and their councils in the state, all these orders were flouted.
